{"id":1729,"date":"2007-09-05T21:08:00","date_gmt":"2007-09-05T21:08:00","guid":{"rendered":"http:\/\/127.0.0.1\/site\/2017\/2\/1985\/state_cant_restrict_seminaries_texas_high_court_rules\/"},"modified":"2007-09-05T21:08:00","modified_gmt":"2007-09-05T21:08:00","slug":"state_cant_restrict_seminaries_texas_high_court_rules","status":"publish","type":"post","link":"https:\/\/kendallharmon.net\/?p=1729","title":{"rendered":"State can&#39;t restrict seminaries, Texas high court rules"},"content":{"rendered":"<p>The Texas Supreme Court ruled Friday that state higher education officials have no authority over seminaries in Texas, ending several years of litigation over state efforts to restrict the operations of three seminaries in Dallas, Fort Worth and San Antonio.<\/p>\n<p>The high court said the Texas Higher Education Coordinating Board violated the constitutional rights of the institutions by preventing them from issuing degrees in theology and calling themselves seminaries.<\/p>\n<p>Writing for the court, Justice Nathan Hecht said state education requirements affecting the institutions &#8220;impermissibly intrude&#8221; upon religious freedom protected by the U.S. and Texas constitutions.<\/p>\n<p>&#8220;Since the government cannot determine what a church should be, it cannot determine the qualifications a cleric should have or whether a particular person has them.
