{"id":36790,"date":"2013-01-15T18:07:07","date_gmt":"2013-01-15T18:07:07","guid":{"rendered":"http:\/\/127.0.0.1\/site\/2017\/2\/1985\/telegraph_christian_wins_right_to_wear_cross_at_work\/"},"modified":"2013-01-15T18:07:07","modified_gmt":"2013-01-15T18:07:07","slug":"telegraph_christian_wins_right_to_wear_cross_at_work","status":"publish","type":"post","link":"https:\/\/kendallharmon.net\/?p=36790","title":{"rendered":"[Telegraph] Christian wins right to wear cross at work"},"content":{"rendered":"<p>The European Court of Human Rights ruled that the UK had failed to protect Nadia Eweida&#8217;s freedom to manifest her faith in the workplace.<\/p>\n<p>But it rejected a similar legal challenge from Shirley Chaplin, a nurse, ruling that the hospital where she worked should be able to refuse permission to wear a cross on \u201chealth and safety\u201d\u009d grounds.<\/p>\n<p>Both women lost employment tribunal cases in Britain after being refused the right to wear a cross as a symbol of their faith under their employers&#8217; uniform policy.<\/p>\n<p>And in a hearing in Strasbourg last year the UK Government argued that this was not a breach of their human rights and wearing a cross is not an essential tenet of Christianity.<\/p>\n<p>But in its judgment the court said that manifesting religion is a &#8220;fundamental right&#8221;.<\/p>\n<p>It added: &#8220;[This is because] a healthy democratic society needs to tolerate and sustain pluralism and diversity; but also because of the value to an individual who has made religion a central tenet of his or her life to be able to communicate that belief to others.&#8221;<\/p>\n<p>The ruling in favour of Mrs Eweida represents a humiliation for David Cameron who promised to change the law to enshrine workers&#8217; right to wear the cross \u201d\u201c even as lawyers for his Government were actively fighting the women in court.<\/p>\n<p>It led to accusations of hypocrisy.<\/p>\n<p>But, in a decision which could have even wider long-term implications, the court also rejected parallel challenges brought by two other Christians who lost their jobs for taking a stand on what they saw as a matter of conscience.<\/p>\n<p><a href=\"http:\/\/www.telegraph.co.uk\/news\/religion\/9802067\/Christian-wins-right-to-wear-cross-at-work.html#\">Read it all<\/a><\/p>\n<p>See also:<br \/>\nBBC: <a href=\"http:\/\/www.bbc.co.uk\/news\/uk-19467554\">Christian Court Cases Explained<\/a> and <a href=\"\">British Airways Christian employee Nadia Eweida wins case<\/a><br \/>\nReuters: <a href=\"http:\/\/uk.reuters.com\/article\/2013\/01\/15\/uk-britain-religion-court-idUKBRE90E0DQ20130115\">British woman wins religious discrimination case<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The European Court of Human Rights ruled that the UK had failed to protect Nadia Eweida&#8217;s freedom to manifest her faith in the workplace.
