After receiving an extension of time, The Falls Church filed on October 9 in the Supreme Court its <a href=\"http:\/\/sblog.s3.amazonaws.com\/wp-content\/uploads\/2013\/11\/TFC-2013-Petition-for-Certiorari-w-Appendix-FINAL.pdf\">petition for writ of certiorari<\/a> (or review) of the decision rendered by the Virginia Supreme Court last April 18 (and its <a href=\"http:\/\/accurmudgeon.blogspot.com\/2013\/06\/no-news-from-texas-sad-news-from.html\">denial of a rehearing on June 14<\/a>).<\/p>\n<p>The ever-cocky Episcopal Church (USA) and the Episcopal Diocese of Virginia, following its lead, declined to file responses to the petition.  Four amici curiae (&#8220;friends of the court&#8221;, being organizations interested in the case) filed briefs in support of The Falls Church: <a href=\"http:\/\/sblog.s3.amazonaws.com\/wp-content\/uploads\/2013\/11\/13-449acBriefOfTheAnglicanChurchInNorthAmerica.pdf\">ACNA<\/a>, <a href=\"http:\/\/sblog.s3.amazonaws.com\/wp-content\/uploads\/2013\/11\/13-449-ac-Presbyterian-Lay-Commommittee-OK-TO-PRINT.pdf\">the Presbyterian Lay Committee<\/a>, <a href=\"http:\/\/sblog.s3.amazonaws.com\/wp-content\/uploads\/2013\/11\/St.-James-Amici-Brief-re-The-Falls-Church.pdf\">St. James Anglican Church<\/a> in Newport Beach, CA, and <a href=\"http:\/\/sblog.s3.amazonaws.com\/wp-content\/uploads\/2013\/11\/Falls-Church-amicus-ISO-cert-v17-clean-proofed-LG-ER.pdf\">the Becket Fund for Religious Liberty<\/a>.  The case went to conference last December just on those briefs. And &#8212; lo and behold! &#8212; the Court ordered ECUSA and its Diocese to file a response before it ruled on the petition.<\/p>\n<p>Such a request is noteworthy, because the Court&#8217;s Rules explain that the Court ordinarily does not grant a pending petition without first calling for a response to it.
