A S Haley Analyzes the Specious Defenses of Judge Kay Hearn’s need not to be Recused from the Anglican/Episcopal Case–Judges Who Are Indifferent to Injustice

Perhaps none of my readers in South Carolina will be surprised to learn that two former colleagues of South Carolina Supreme Court Justice Kaye Hearn, both retired judges who sat with her for many years on that State’s Court of Appeals, have appeared as “friends of the court” (amici curiae) in the Episcopal Church case on her behalf. That case (Protestant Episcopal Church in the Diocese of South Carolina et al. v. The Episcopal Church et al., No. 27731, August 2, 2017) has been the subject of four of my last seven postings here (report of decision, first critical observations re: bias of Justice Hearn, summary of grounds for her disqualification, and summary of grounds for granting a rehearing).

Now come the Hon. William T. Howell and the Hon. H. Samuel Stilwell, retired from the Court of Appeals, to argue to the Justices of the State Supreme Court that (a) the motion to disqualify Justice Hearn comes too late for it to be acted upon, and (b) in any event, no foul has occurred — there has been no violation of due process, because their former colleague did nothing wrong by deciding the case as she did. Oh, and did I mention that the signer (and presumably principal author) of the brief for the amici curiae is Matthew Richardson, who served in the past as a law clerk to Justice Hearn?

In support of (and attached to) this brief are two affidavits. The first is from Rebecca Lovelace, a witness who testified at trial on behalf of those claiming all the properties of the withdrawing parishes, who is a long-time personal friend and fellow parishioner of the Justice and her husband, George Hearn, and who was on the steering committee that organized the appellant Episcopal Church in South Carolina (ECSC). The second affidavit comes from Prof. Gregory B. Adams of the University of South Carolina School of Law, who does not, however, disclose that he himself is a member in good standing of the parish of Good Shepherd in Columbia — which, as a constituent of the Diocese of Upper South Carolina, has remained in ECUSA.

So one would expect to read a thoroughly impartial and unbiased series of legal documents, right? And if that is what you expect, then you might as well stop reading right now.

Earlier, I analogized Justice Hearn’s role in this case to that of a member of a golf club who sees nothing wrong in sitting as judge over a property dispute that results in the transfer to her own club of millions of dollars of real estate titled in the name of a competing golf club. If that analogy holds up, then I will liken the filing of this amicus brief to testimony offered in her support, in a proceeding against the judge to disqualify her for bias, by four members of the judge’s same club. And that is not also bias?

(NYTBR) Marilynne Robinson reviews Stephen Greenblatt’s new book ‘The Rise And Fall Of Adam And Eve’

Stephen Greenblatt follows Adam and Eve through a long arc of Western history. He begins at the beginning, with paleoanthropology, then moves on to the Babylonian epics, which influenced the early chapters of Genesis, and on to a sketch of the life of St. Augustine. From there, he arrives at the Renaissance and its depictions of the first and perfect man and woman, then Milton, of course, the age of discovery and the rationalist rejection of Adamic creation, which was a rejection as well of the belief that, as St. Augustine said, “God willed to create all men out of one, in order that they might be held in their society not only by likeness of kind, but also by bond of kindred.” Europeans found that the great world teemed with people toward whom they felt little likeness and less kindred. Then Darwin emerged, upending everything all over again. And Greenblatt finally lands in his last pages at a fairly disheartening account of mating among the chimpanzees. This is the march of progress, tinged with melancholy, as always.

There is, however, a complicating factor here, having to do with the question of truth. Greenblatt, an English professor at Harvard University and author of the National Book Award-winning “The Swerve,” frames his inquiry in terms of truth or fiction. For him truth means plausibility, and by that measure the story of Adam and Eve is no more than a miracle of storytelling. But science tells us that Homo sapiens does indeed roughly share a single lineage, in some sense a common origin, just as ancient Genesis says it does. In the Hebrew Bible the word adam often means all humankind, mortals. Greenblatt never seems to consider why the myth might have felt so true to those who found their religious and humanist values affirmed by it — and their own deepest intuitions, which science has partly borne out. It is interesting that those who claim to defend the creation narrative from rationalist critiques ignore the fact that its deepest moral implications, a profound human bond and likeness, have been scientifically demonstrated.

(ABC Aus.) Sydney Anglican Church confesses to domestic abuse in its ranks, plans to reform with new policy

The Anglican Diocese of Sydney is set to unveil a policy designed to root out violence in Anglican families and take aim at offenders in the hierarchy of the church by ensuring clergy and church staff who abuse their spouse are seriously disciplined.

The comprehensive policy and good practice guidelines have been developed by the church’s Domestic Violence Task Force, which this evening will recommend to Synod that it “make a confession” that domestic abuse is a problem within the church and apologise for failures to “respond well pastorally” to such situations.

Family violence experts have applauded the policy as a “good start” that will, if implemented, make the church a safer place.

But critics have also lashed out at the Sydney Diocese for donating $1 million to the No campaign against same-sex marriage, while allocating only a few thousand dollars to the Domestic Violence Task Force.

David Ould–Partial Anglican Primates meeting abandons the Scottish faithful

The reality is that the “consequences” agreed to at the 2016 Primates’ meeting have been all but ignored. The Anglican Consultative Council chose to effectively ignore the Primates’ request and the Archbishop of Canterbury, rather than insisting that they were implementing, simply accepted the outcome. Hence the language in this year’s communiqué that he “will take steps within his authority”. i.e., where he has no “authority” there is no chance of anything happening. The Primus of the SEC, Bishop Mark Strange, must have been quaking in his boots at that one.

Worse was to come:

We discussed difficulties arising from cross-border interventions, agreeing that the principles were clearly stated from the Council of Nicaea onwards and in the 1998 Lambeth Conference. We recognised that there were opportunities for joint initiatives and mission partnerships for the benefit of the Gospel where these are agreed between Provinces. However consent was critical to any inter-provincial collaboration and it was essential that courtesy and love should be extended to Provinces at all times.

Attempts to deal with breaches of consent and courtesy should be made in regional Primates’ Meetings and only referred to the Secretary General and the Archbishop of Canterbury as a last resort. We recognised that persistent and deliberate non-consensual cross-border activity breaks trust and weakens our communion.

We recognised that there is a need for a season of repentance and renewal including where interventions may have happened without prior permission having being sought.

These are three paragraphs that expose just how poor the outcome of this meeting was. First note the language used here which refers to the recent GAFCON consecration of Andy Lines. It is a “breach of consent and courtesy” which is “persistent and deliberate” and “non-consensual”. It “breaks trust and weakens our communion” and requires “repentance and renewal”.

Compare to the language used above of the SEC’s actions: “the distance that exists in our relationships due to deep differences in understanding on same sex marriage”. You would think that it was simply a misunderstanding by family members. The language is clearly not as strong. Further there is zero mention of the ongoing position of TEC and the Canadian Church (ACC). If there is persistent and deliberate action then surely it is the absolute refusal of TEC, Canada, Scotland (and perhaps, soon, New Zealand) to desist from their path of deliberately rejecting Jesus’ words on what marriage is. Yet it is not even mentioned, let alone in the tone of language reserved for GAFCON. The remedial action is roundly criticised yet the heresy (for that is what it is) that caused the crisis is treated like a spat between siblings.

The Scottish Anglican Network Statement on the Partial Meeting of the Primates of the Anglican Communion

The Scottish Anglican Network is grateful to the GAFCON primates who gave courageous leadership by not attending the meeting of the Primates of the Anglican Communion this week. We are thankful too for the GAFCON Primates and others who did attend and who robustly supported the complementary nature of biblical marriage.

The Scottish Episcopal Church now faces the same consequences as The Episcopal Church (USA). Although these consequences are very mild indeed, they indicate that the SEC has departed from the faith once given, and that many provinces are now in seriously impaired communion with it.

We know that, “Godly sorrow brings repentance” (2 Corinthians 7:10a). We hope that the intention of the Primates’ meeting, despite the Scottish Primus’ clear determination to not turn back from the decision of his province, is to allow the Scottish Episcopal Church time to repent of the damage it is doing by its schismatic action. The sad alternative is that this is poor leadership hoping that the problem will somehow go away.

We pray that the Holy Spirit will convict the leadership of the SEC of this need to repent and that the Primates of the Anglican Communion will continue to uphold the orthodox understanding of marriage.

Thoughts on the Partial Primates Meeting from Archbishop Gregory Venables

Are The Primates Walking Together?

What was identified clearly in the meeting is that some aren’t walking together, some are walking together but at a distance, and some are walking together. But even those three ways of grouping that situation don’t deal with the issue. The issue is, why aren’t people walking together? And we aren’t walking together because the situation has not been dealt with.

Does it Matter?

People are being led away from the truth. People are being led away from the safe place that God has provided in his Son Jesus Christ who died for our sin. He didn’t just die to affirm us and get on because everything is alright. He died because we were in rebellion and separated eternally from God. So a sort of “sanction” might look fine for those who are looking for some way of saying, ‘well, it’s not right.’

A Sydney Anglicans Article on the Opening of Diocesan Synod–‘Timeless gospel meets changing world’

Archbishop Glenn Davies has used his Presidential Address, delivered within days of the 500 year anniversary of the start of the Reformation, as a rallying call to stand firm in proclaiming the gospel….

Dr Davies started his address with the traditional acknowledgement to aboriginal people and the told the Synod “While we have much to regret in the establishment of a British colony that dispossessed the Aboriginal people of their land, and led to the destruction of Aboriginal culture, we do rejoice in the ministry of people like Richard Johnson and Thomas Hassall, who reached out to the indigenous population of their day with the gospel of God’s love. That task continues to be our first priority—a gospel for all people.”

“I am not sure what activities were taking place in the Sydney basin 500 years ago, but in another land and among a foreign people far removed from Australia’s shores a young monk was nailing 95 propositions on the door of the castle church in Wittenberg. He too was concerned with the gospel of God’s grace, which he saw as being distorted and corrupted by the teachings and practices of the Roman Church.”

The Archbishop went on to congratulate Sydney churches for celebrating the Reformation anniversary. “We cannot assume that our own people, let alone the general population of Sydney, fully understand the significance of the Reformation upon the church of God, grounded in the rediscovery of the authority of the Word of God. Every opportunity that we have to shine the light of the gospel into the darkness of our society ought to be welcomed with open arms.”

Archbishop Glen Davies’ Presidential Address at the Sydney Diocesan Synod

Brothers and sisters, as the penetration of the gospel diminishes in our society, we find ourselves being moved in a more libertarian direction under the influence of those who want to abandon the mores of the past. Yet at the same time these permissive forces who espouse the virtue of ‘tolerance’ are seeking to impose restrictions upon those who wish to maintain the values on which our nation has been founded. This has become nowhere more apparent than in the current debate surrounding the postal survey on same-sex marriage. While the advocates of the ‘Yes’ campaign have been unrelenting in their attempts to redefine marriage, they have also been virulent in their opposition to those who hold a contrary view. The innocent inclusion of drinking Coopers beer in the Bible Society’s promotion of an informed and civilised debate between two politicians, each holding opposing views on same-sex marriage, is a case in point. It resulted in an uncivilised, unwarranted and malicious campaign through social media to boycott Coopers Breweries. Similarly, a Christian doctor whoappeared in an advertisement opposing same-sex marriage was subject to a campaign to have her medical registration withdrawn. Witness also the ludicrous attempt to rename Margaret Court Arena, merely because Margaret Court, one of our greatest Australian athletes, went public on her opposition to same-sex marriage.

(Macleans) The odd, complicated history of Canadian Thanksgiving

This time last year, the New York Times—and its many readers—discovered a quaint little tradition that many Americans had never heard of: Canadian Thanksgiving.

Some of the confusion over our version of the holiday stems from the fact that we celebrate it six weeks earlier than they do—and on their Columbus Day holiday, to boot. Most of it, however, is surely owing to the fact that Americans feel ownership over this holiday, believing it grew, organically, out of a specific historical event that took place on “American” soil. After all, the Plymouth Rock story, which frames a congenial harvest feast shared by Wampanoag peoples and the Pilgrim settlers in November 1621 as America’s first Thanksgiving, is taught early and often.

In response, on occasion, some defensive writers and apologists have countered the implication that we are pale imitators of the U.S. or mere holiday rip-off artists, and people have pointed to Canadian antecedents to demonstrate our authentic connection. Some cite a celebratory meal held by Martin Frobisher upon his arrival in 1578, but since that involved tinned beef and mushy peas, that feels like a stretch. More germane than this story is the meaty celebration hosted by Samuel de Champlain in Port-Royal on Nov. 14, 1606, which saw Europeans and Indigenous peoples breaking bread together. It was organized as part of the “Order of Good Cheer” dinner party series that was invented to make sure the colonists ate and drank enough to stave off scurvy and malnutrition.

(Local Paper) More South Carolinians are going to emergency rooms with STDs. Doctors say that’s not ideal.

[Dr’ John] Walters said he can rarely treat STIs effectively in an emergency setting. Lab tests require days to confirm the diagnosis, so he is often left with no option but to treat without a positive test or send the patient home empty-handed.

Pearson and his colleagues at the CDC found there was a 2 percent increase between 2008 and 2013 in the total number of emergency visits, and a 39 percent increase, specifically, in STI-related visits. They found patients receiving STI care in emergency departments were typically not white and usually were covered by public insurance programs, like Medicaid. They included in their research cases of chlamydia, gonorrhea and “unspecified venereal disease,” the most common STIs.

South Carolina hasn’t escaped the national trend. Between 2010 and 2014, there was nearly a 30 percent increase in the number of people showing up to South Carolina emergency departments with STIs, according to data from the Agency for Healthcare Research and Quality. Although syphilis was not included in the CDC study because it is less common, that particular sexually transmitted disease has also long been on the rise in South Carolina.

Once again, a federal judge has declared that the longstanding clergy housing allowance violates the establishment clause of the First Amendment.

Offered only to “ministers of the gospel,” the 60-year-old tax break excludes the rental value of a home from the taxable income of US clergy. It’s the “most important tax benefit available to ministers,” according to GuideStone Financial Resources.

It’s also the biggest: American ministers currently avail themselves of the tax break to the tune of $800 million a year, according to the latest estimate by the congressional Joint Committee on Taxation.

Wisconsin district judge Barbara Crabb first ruled against the housing allowance in 2013, finding that the second part of Section 107 of the IRS tax code provides “a benefit to religious persons and no one else, even though doing so is not necessary to alleviate a special burden on religious exercise.” Her ruling “sen[t] shockwaves through the religious community,” the Evangelical Council for Financial Accountability stated at the time.

(NYT) As Overdose Deaths Pile Up, a New Hampshire Medical Examiner Quits the Morgue

In the state morgue here, in the industrial maze of a hospital basement, Dr. Thomas A. Andrew was slicing through the lung of a 36-year-old woman when white foam seeped out onto the autopsy table.

Foam in the lungs is a sign of acute intoxication caused by an opioid. So is a swollen brain, which she also had. But Dr. Andrew, the chief medical examiner of New Hampshire, would not be certain of the cause of death until he could rule out other causes, like a brain aneurysm or foul play, and until after the woman’s blood tests had come back.

With the nation snared in what the government says is the worst drug epidemic in its history, routine autopsies like this one, which take more than two hours, are overtaxing medical examiners everywhere.

“It’s almost as if the Visigoths are at the gates, and the gates are starting to crumble,” Dr. Andrew said. “I’m not an alarmist by nature, but this is not overhyped. It has completely overwhelmed us.”

(CC) Craig Barnes– Things are always falling apart: Is there a center that can hold?

Colossians 1 is relentless in its claim that all things hold together in Jesus Christ. The phrase “all things” is used five times in six verses, underlining the point: nothing is left out of the realm of redemption. Christ is the center of all things, and this includes both us and them. It includes those who don’t know they are included and even those who don’t want to be included.

At a time when society is again falling apart into combative factions of us and them, let at least the church believe that all things are centered in a Savior. And that this center will hold.

(Gafcon Uk) Response from Bishop Andy Lines to the Primates’ Communiqué

The Bishop Primus of the Scottish Episcopal Church played a leading role in the Primates’ Conference. Although there was talk of ‘consequences’ for SEC’s action, he was unrepentant, and showed no concern for those under his care who cannot accept the decision to redefine marriage. They now feel betrayed and de-churched. Meanwhile millions of Anglicans will be concerned that the Communiqué does not appear to express any view on the actions of SEC or the thinking behind it.

The document does not address false teaching, but focuses on ‘border crossing’ as if it is more harmful. I take the long-established view of orthodox Anglicans across the world, that we cannot make an equivalence between Provinces who choose to abandon key aspects of biblical theology and ethics, tearing the fabric of the Communion and putting souls in danger, and those who respond to calls for help from faithful Anglicans within those Provinces. My role as Gafcon missionary Bishop is clearly needed more than ever: to provide ministry to and encourage emerging congregations of faithful Anglicans in Britain outside the official structures.

(NYT) Justin Wolfers–Can We pinpoint Racial Discrimination by Government Officials?

A team of economists has uncovered persuasive evidence that local government officials throughout the United States are less responsive to African-Americans than they are to whites.

The researchers sent roughly 20,000 emails to local government employees in nearly every county. The emails posed commonplace questions, like “Could you please tell me what your opening hours are?”

The emails were identical except that half appeared to come from a DeShawn Jackson or a Tyrone Washington, names that have been shown to be associated with African-Americans. The other half used names that have been shown to be associated with whites: Greg Walsh and Jake Mueller. The email sent to each local officeholder was determined by chance.

Most inquiries yielded a timely and polite response. But emails with black-sounding names were 13 percent more likely to go unanswered than those with white-sounding names. This difference, which appeared in all regions of the country, was large enough that it was statistically unlikely to have been a matter of mere chance.

And when he had seized him, he put him in prison, and delivered him to four squads of soldiers to guard him, intending after the Passover to bring him out to the people. So Peter was kept in prison; but earnest prayer for him was made to God by the church.

The very night when Herod was about to bring him out, Peter was sleeping between two soldiers, bound with two chains, and sentries before the door were guarding the prison; and behold, an angel of the Lord appeared, and a light shone in the cell; and he struck Peter on the side and woke him, saying, “Get up quickly.” And the chains fell off his hands. And the angel said to him, “Dress yourself and put on your sandals.” And he did so. And he said to him, “Wrap your mantle around you and follow me.” And he went out and followed him; he did not know that what was done by the angel was real, but thought he was seeing a vision. When they had passed the first and the second guard, they came to the iron gate leading into the city. It opened to them of its own accord, and they went out and passed on through one street; and immediately the angel left him. And Peter came to himself, and said, “Now I am sure that the Lord has sent his angel and rescued me from the hand of Herod and from all that the Jewish people were expecting.”

When he realized this, he went to the house of Mary, the mother of John whose other name was Mark, where many were gathered together and were praying. And when he knocked at the door of the gateway, a maid named Rhoda came to answer. Recognizing Peter’s voice, in her joy she did not open the gate but ran in and told that Peter was standing at the gate. They said to her, “You are mad.” But she insisted that it was so. They said, “It is his angel!” But Peter continued knocking; and when they opened, they saw him and were amazed. But motioning to them with his hand to be silent, he described to them how the Lord had brought him out of the prison. And he said, “Tell this to James and to the brethren.” Then he departed and went to another place.

The Rector of Saint Philips, Charleston, writes his Parish about the proposed mediation process in the South Carolina Anglican-Episcopal Dispute

Dear Friends,

From November 6-8, representatives of the Diocese of South Carolina and the Episcopal Church will be engaged in mediation under the direction of retired federal judge Joseph Anderson in Columbia. Both parties have agreed to mediate all issues currently pending before the State and Federal courts.

This is another step along the way toward resolution, but unlike arbitration, mediation is not binding on either party, and this is no guarantee of a positive outcome for the Diocese. It would be unwise to assume that this will necessarily resolve the litigation or guarantee that we will ultimately prevail. Instead, this is an opportunity for us to engage in fervent prayer. As Christians, we have the great privilege of laying our burdens, fears, and hopes before our Heavenly Father, and I encourage you to do so between now and the conclusion of the mediation on November 8.

Please remember Bishop Lawrence and our legal team as you pray, but also include Bishop Skip Adams and the legal representatives from TEC. It may be difficult to bless our adversaries and pray for those who appear to persecute us, but it is the Christian way. It is our hope that in ALL things Jesus Christ may be glorified, so pray especially that God’s will may be done on earth as it is in heaven, and that the ministry of St. Philip’s and the Diocese of South Carolina may continue unfettered and undeterred.
