(WSJ) Jack Philips on the Masterpiece Cakeshop Decision–The Supreme Court Let Me Live My Faith Again

Religion isn’t something I pick up on Sunday mornings only to put away during the rest of the week. My entire life belongs to Jesus, and I believe that everything I do should honor him. As the Bible says, “Whatever you do, in word or deed, do everything in the name of the Lord Jesus” (Colossians 3:17).

This means that when I operate my business, I am always mindful of whether God is pleased with what I create. That’s why even though I serve all people, I can’t design cakes that celebrate events or express messages that conflict with my faith. It’s also why I’ve declined requests to create cakes that celebrate Halloween or memorialize a divorce.

My beliefs about marriage come from my reading of the Bible. Describing marriage, Jesus said, “A man shall leave his father and mother and hold fast to his wife, and the two shall become one flesh” (Mark 10:7-8). This shows clearly that God intends marriage to be a union between a husband and a wife.

On the day I declined to create a wedding cake celebrating a same-sex marriage, I was simply living out the truth that I—along with millions of other Christians—have found in the Bible. The men who sued me say I discriminated against them. That’s not true. Declining to design something because of what it celebrates isn’t the same as refusing to serve people because of who they are. Those men are welcome in my shop today, just as they were in 2012. But I can’t create a cake that celebrates a view of marriage at odds with my Christian beliefs.

(1st Things) Hadles Arkes on the Supreme Court Masterpiece Cakeshop Decision–Conservative Jurisprudence Resorts To Relativism

For Kennedy, this diatribe against the religious was reprehensible in the same measure: “To describe a man’s faith as ‘one of the most despicable pieces of rhetoric that people can use’ is to disparage his religion in at least two distinct ways: by describing it as despicable, and also by characterizing it as merely rhetorical—something insubstantial and even insincere.”

Yes, but so what? Kennedy did not challenge the law itself as a violation of Phillips’s religious freedom. Why should it matter that commissioners, enforcing the law, allowed their conviction of its rightness to express itself in some gratuitous sneering at a man Justice Kennedy and the Court were still willing to treat as a wrongdoer? What this situation seemed to violate, for Kennedy, was the “State’s duty under the First Amendment not to base laws or regulations on hostility to a religion or religious viewpoint.” For years it was understood that the law need not be at all “neutral” between religion and irreligion, that there were compelling reasons, for the public good, to encourage the religious life. But now the claim is reduced simply to an obligation not to be indecorously nasty while the law refuses to respect religious convictions.

(TLC Covenant) Ephraim Radner–Pastoral Faithfulness in Opaque Times

Trocmé fascinates me because I see aspects of our time and church in his witness. Debate and anxiety is now bubbling up, especially among more traditional Episcopalians, in the face of this summer’s General Convention, as it proposes to alter the definition of marriage and perhaps even change of the Book of Common Prayer to reflect this new understanding. Older priests — and I am still a priest of the Episcopal Church — wonder where this will leave us. Younger priests wonder what will become of the church they have committed themselves by oath to serve. And those who have felt the call to ordination now wonder if there is a viable future for them in a church that may not only reject their understanding of deep Christian truth, but will in any case lurch further onto a path of conflict and promised decline.

For me, the issue of marriage is not adiaphora; it is bound to the central claims of the Christian gospel. This is not the place to rehearse the arguments. But the simple axis of Genesis 1-2, Mark 10, and Ephesians 5, which speak to the creation of man and woman, their union, and the nature of the body of Christ, seems to form a scriptural scaffolding of divine purpose and destiny that any redefinition of marriage must intrinsically deny. Trocmé liked to speak of “absolutes” — and in the case of nonviolence, he considered this to be an “absolute.” I do not like the term, for various reasons. But if I were to use it, I would certainly apply it to the reality of marriage between a man and a woman: this is an “ontological absolute.”

The question for me, then, is how we shall properly witness to this absolute in the face of our church’s rejection of its meaning. This is where Trocmé’s example is such a challenge to me. When one of his deepest theological convictions was not only challenged but rejected by his church, and as he watched his friends led away to prison with questionable support from their ecclesial authorities, he chose to carry on his pastoral work where he was.

(Church Times) Bishop of London relishes diversity in the city at interfaith Iftar

At one of her first public engagements since being installed last month (News, 17 May), Bishop Mullally said that diversity in London was something to be proud of.

She was speaking to more than 100 young people, including representatives from schools across London, at an Iftar organised by the Naz Legacy Foundation.

The event, at the St John’s Wood Synagogue, ended with the breaking of the Ramadan fast at sunset. The speakers were Bishop Mullally; the Mayor of London, Sadiq Khan; the Archbishop of Westminster, Cardinal Vincent Nichols; and the Chief Rabbi, Ephraim Mirvis.

Bishop Mullally said: “One of the great joys of coming back to London is its diversity. There is something in that diversity that we should be proud of. The opportunity of interfaith dialogue is that we can gain an understanding of each other. . . As people of faith, we have an ability to strengthen this city. We hold the opportunity to strengthen a city that is already strong.”

Bishop Mullally praised the young people who were there to talk about interfaith matters, noting that “today itself is a small step, but it has an enormous impact”….

Roland Allen in his own words on Mission and Saint Paul

In little more than ten years St. Paul established the Church in four provinces of the Empire, Galatia, Macedonia, Achaia and Asia. Before AD 47 there were no churches in these provinces; in AD 57 St. Paul could speak as if his work there was done, and could plan extensive tours into the far west without anxiety lest the churches which he had founded might perish in his absence for want of his guidance and support.

The work of the Apostle during these ten years can therefore be treated as a unity. Whatever assistance he may have received from the preaching of others, it is unquestioned that the establishment of the churches in these provinces was really his work. In the pages of the New Testament he, and he alone, stands forth as their founder. And the work which he did was really a completed work. So far as the foundation of the churches is concerned, it is perfectly clear that the writer of the Acts intends to represent St. Paul’s work as complete. The churches were really established. Whatever disasters fell upon them in later years, whatever failure there was, whatever ruin, that failure was not due to any insufficiency or lack of care and completeness in the Apostle’s teaching or organization. When he left them he left them because his work was fully accomplished.

This is truly an astonishing fact. That churches should be founded so rapidly, so securely, seems to us today, accustomed to the difficulties, the uncertainties, the failures, the disastrous relapses of our own missionary work, almost incredible. Many missionaries in later days have received a larger number of converts than St. Paul; many have preached over a wider area than he; but none have so established churches. We have long forgotten that such things could be. We have long accustomed ourselves to accept it as an axiom of missionary work that converts in a new country must be submitted to a very long probation and training, extending over generations before they can be expected to be able to stand alone. Today if a man ventures to suggest that there may be something in the methods by which St. Paul attained such wonderful results worthy of our careful attention, and perhaps of our imitation, he is in danger of being accused of revolutionary tendencies.

To give a human example, brethren: no one annuls even a man’s will, or adds to it, once it has been ratified. Now the promises were made to Abraham and to his offspring. It does not say, “And to offsprings,” referring to many; but, referring to one, “And to your offspring,” which is Christ. This is what I mean: the law, which came four hundred and thirty years afterward, does not annul a covenant previously ratified by God, so as to make the promise void. For if the inheritance is by the law, it is no longer by promise; but God gave it to Abraham by a promise. Why then the law? It was added because of transgressions, till the offspring should come to whom the promise had been made; and it was ordained by angels through an intermediary. Now an intermediary implies more than one; but God is one.

Is the law then against the promises of God? Certainly not; for if a law had been given which could make alive, then righteousness would indeed be by the law. But the scripture consigned all things to sin, that what was promised to faith in Jesus Christ might be given to those who believe.

Two New Bishops elected in the Scottish Episcopal Church

The Rev Canon Ian Paton has today been elected as the new Bishop of St Andrews, Dunkeld & Dunblane, and The Very Rev Andrew Swift has been elected as the new Bishop of Brechin.

The election of the new bishop was carried out by an Electoral Synod in each Diocese (comprising representatives of clergy and lay members from the Diocese). The Primus of the Scottish Episcopal Church, the Most Rev Mark Strange, says “I am delighted that the Electoral Synods have elected Ian Paton and Andrew Swift as their new Bishop in each of their Dioceses and I thank the members of the Electoral Synod for the work that they have done in this process.

“I look forward to welcoming both Ian and Andrew to the College of Bishops and to working with them, and I am sure that the Diocese of St Andrews, Dunkeld & Dunblane and the Diocese of Brechin will look forward to their respective leadership and inspiration in the future development of Mission and Ministry across each of the Dioceses. I ask that we hold them both in prayer as they each move to a new stage of their ministry and prepare for their consecration.”

(BBC) Abuse inquiry seeks Peter Ball statement from Prince Charles

The Prince of Wales has been asked to give a witness statement to a public inquiry about a paedophile bishop who was jailed after abusing young men.

Peter Ball, 85, was jailed for 32 months in October 2015 for offences against 18 teenagers and men.

The former Bishop of Lewes and of Gloucester carried out the abuse between the 1970s and 1990s.

Prince Charles exchanged a series of letters with Ball, whose Gloucester diocese covers his Highgrove home….

(NPR Shots blog) CDC: U.S. Suicide Rates Have Climbed Dramatically

Suicide rates have increased in nearly every state over the last two decades, and half of the states have seen suicide rates go up more than 30 percent.

Suicide is a major public health issue, accounting for nearly 45,000 deaths in 2016 alone. That’s why the Centers for Disease Control and Prevention in Atlanta decided to take a comprehensive look at suicides from 1999 to 2016.

“Suicide in this country really is a problem that is impacted by so many factors. It’s not just a mental health concern,” says Deborah Stone, a behavioral scientist at the CDC and the lead author of the new study. “There are many different circumstances and factors that contribute to suicide. And so that’s one of the things that this study really shows us. It points to the need for a comprehensive approach to prevention.”

She and her colleagues collected data on suicide deaths from all states. In addition, to better understand the circumstances surrounding suicide, they turned to more detailed information collected by 27 states on suicides that occurred in 2015.

(NPR’s Marketplace) The business of dealing with China’s cheating husbands

Dai’s charges can add up to more than $150,000 for two months of work, which is far more than what he could earn as a high school graduate in his hometown in eastern Jiangsu province. Wives of wealthy men are willing to pay his fees because China’s divorce law favors the man and divorce is still a major stigma.

“It can affect your children. They will be less desirable as marriage candidates,” Dai said.

There is no guarantee of success in marriage dissuading. Dai said only 50 percent of his cases work out. He refers to the mistress as a “cancer in the marriage.”

“We are merely doing an external surgery. Whether the marriage can be saved depends on the couple,” Dai said.

(WSJ) Ryan Anderson–Discrimination Law Isn’t Supposed to ‘Punish the Wicked’

If those playing down the importance of the Masterpiece Cakeshop ruling are wrong, those overstating it are also off base. “Family Guy” creator Seth MacFarlane claimed that “it’s a shorter walk than we think, particularly today, from ‘I won’t bake them a cake because they’re gay’ to ‘I won’t seat him here because he’s black.’ ” This wildly mischaracterizes Mr. Phillips’s position. The Masterpiece proprietor serves all customers, regardless of sexual orientation, but he can’t in good conscience communicate all messages or celebrate all events. He is motivated by his Christian belief that marriage unites husband and wife, not his customer’s identity.

This disagreement about the definition of marriage occurs among people of good faith motivated by honorable theological and philosophical premises, as Justice Kennedy recognized in Obergefell v. Hodges, the 2015 same-sex-marriage decision. And as he wrote in Masterpiece, “religious and philosophical objections to gay marriage are protected views and in some instances protected forms of expression.”

That is why states should be careful not to abuse antidiscrimination policy in a way that amounts to an enforcement of an orthodoxy regarding questions about sex on which reasonable people can disagree.

Monday’s ruling won’t open the floodgates to invidious discrimination as critics imagine. But neither should we gainsay its wider applicability. The Supreme Court has said clearly that the government may not punish people because of their religious beliefs. Any generally applicable, neutral law must serve the common good, not punish those whom people in power deem to be “wicked.”

Dear St. Philip’s Family,
On Thursday, June 7, the justices of the Supreme Court of the United States will gather to consider whether or not to grant our petition for a Writ of Certiorari. We believe that this is the best way to bring clarity to the conflicted legal landscape and resolution to the protracted battle between the Diocese of South Carolina and the Episcopal Church. While this is a hopeful sign, it is not a guaranteed thing. The justices grant only a small percentage of the thousands of petitions that they receive annually, and we cannot assume that they will take ours.
However, the Epistle of James reminds us that the “effectual fervent prayer of a righteous man availeth much,” and as Christians, we can be sure that the judge of all the earth will do right. To this end, I want to invite you to join me at noon on June 7 in the Church for a special prayer service led by Bishop Lawrence. It will be a time for us to ask for forgiveness, to pray for deliverance, and to seek the Lord’s guidance for our parish and diocese. Prayer is one of the greatest privileges we have as believers, and we can approach our Heavenly Father with confidence. To borrow a phrase from Alfred, Lord Tennyson, “More things are wrought by prayer than this world dreams of.”
We will have a nursery available for children ages five and younger, and I strongly encourage allparishioners to make this service a priority. It is not just the future of St. Philip’s that is at stake; it is the American right to worship freely that is in jeopardy. In the meantime, let us not lose heart, but let us carry on with the work the Lord has given us to do, confident that even now, He is doing for us “greater things than we can ask for or imagine”!

Franklin Delano Roosevelt’s D-Day Prayer on June 6, 1944

“My Fellow Americans:

“Last night, when I spoke with you about the fall of Rome, I knew at that moment that troops of the United States and our Allies were crossing the Channel in another and greater operation. It has come to pass with success thus far.

“And so, in this poignant hour, I ask you to join with me in prayer:

“Almighty God: Our sons, pride of our nation, this day have set upon a mighty endeavor, a struggle to preserve our Republic, our religion, and our civilization, and to set free a suffering humanity.

“Lead them straight and true; give strength to their arms, stoutness to their hearts, steadfastness in their faith.

Remembering D-Day–Winston Churchill’s Speech, June 6, 1944

I have also to announce to the House that during the night and the early hours of this morning the first of the series of landings in force upon the European Continent has taken place. In this case the liberating assault fell upon the coast of France. An immense armada of upwards of 4,000 ships, together with several thousand smaller craft, crossed the Channel. Massed airborne landings have been successfully effected behind the enemy lines, and landings on the beaches are proceeding at various points at the present time. The fire of the shore batteries has been largely quelled. The obstacles that were constructed in the sea have not proved so difficult as was apprehended. The Anglo-American Allies are sustained by about 11,000 firstline aircraft, which can be drawn upon as may be needed for the purposes of the battle. I cannot, of course, commit myself to any particular details. Reports are coming in in rapid succession. So far the Commanders who are engaged report that everything is proceeding according to plan. And what a plan! This vast operation is undoubtedly the most complicated and difficult that has ever taken place. It involves tides, wind, waves, visibility, both from the air and the sea standpoint, and the combined employment of land, air and sea forces in the highest degree of intimacy and in contact with conditions which could not and cannot be fully foreseen.

There are already hopes that actual tactical surprise has been attained, and we hope to furnish the enemy with a succession of surprises during the course of the fighting. The battle that has now begun will grow constantly in scale and in intensity for many weeks to come, and I shall not attempt to speculate upon its course. This I may say, however. Complete unity prevails throughout the Allied Armies. There is a brotherhood in arms between us and our friends of the United States. There is complete confidence in the supreme commander, General Eisenhower, and his lieutenants, and also in the commander of the Expeditionary Force, General Montgomery. The ardour and spirit of the troops, as I saw myself, embarking in these last few days was splendid to witness. Nothing that equipment, science or forethought could do has been neglected, and the whole process of opening this great new front will be pursued with the utmost resolution both by the commanders and by the United States and British Governments whom they serve. I have been at the centres where the latest information is received, and I can state to the House that this operation is proceeding in a thoroughly satisfactory manner. Many dangers and difficulties which at this time last night appeared extremely formidable are behind us. The passage of the sea has been made with far less loss than we apprehended. The resistance of the batteries has been greatly weakened by the bombing of the Air Force, and the superior bombardment of our ships quickly reduced their fire to dimensions which did not affect the problem. The landings of the troops on a broad front, both British and American- -Allied troops, I will not give lists of all the different nationalities they represent-but the landings along the whole front have been effective, and our troops have penetrated, in some cases, several miles inland. Lodgments exist on a broad front.

Rabbi Jonathan Sacks–Seeing What Isn’t There: A Reflection on the Sending out of and Reporting back from the Spies in Canaan (Numbers 13)

His name is Aaron T. Beck and he is the founder of one of the most effective forms of psychotherapy yet devised: Cognitive Behavioural Therapy. He discovered it through his work at the depression research clinic he founded in the University of Pennsylvania. He began to detect a pattern among his patients. It had to do with the way they interpreted events. They did so in negative ways that were damaging to their self-respect, and fatalistic. It was as if they had thought themselves into a condition that one of Beck’s most brilliant disciples, Martin Seligman, was later to call “learned helplessness.” Essentially they kept telling themselves, “I am a failure. Nothing I try ever succeeds. I am useless. Things will never change.”

They had these thoughts automatically. They were their default reaction to anything that went wrong in their lives. But Beck found that if they became conscious of these thoughts, saw how unjustified they were, and developed different and more realistic thought patterns, they could, in effect, cure themselves. This also turns out to be a revelatory way of understanding the key episode of our parsha, namely the story of the spies.

Recall what happened. Moses sent twelve men to spy out the land. The men were leaders, princes of their tribes, people of distinction. Yet ten of them came back with a demoralising report. The land, they said, is indeed good. It does flow with milk and honey. But the people are strong. The cities are large and well fortified. Caleb tried to calm the people. “We can do it.” But the ten said that it could not be done. The people are stronger than we are. They are giants. We are grasshoppers.

And so the terrible event happened. The people lost heart. “If only,” they said, “we had died in Egypt. Let us choose a leader and go back.” God became angry. Moses pleaded for mercy. God relented, but insisted that none of that generation, with the sole exceptions of the two dissenting spies, Caleb and Joshua, would live to enter the land. The people would stay in the wilderness for forty years, and there they would die. Their children would eventually inherit what might have been theirs had they only had faith.

Essential to understanding this passage is the fact that the report of the ten spies was utterly unfounded.

(Gallup) 43% of Americans Say Pornography Is Morally Acceptable, up from 36% in 2017

Forty-three percent of Americans now believe pornography is “morally acceptable,” a seven-percentage-point increase from last year and the highest level since Gallup first began measuring moral perceptions of pornography in 2011.

These results come from Gallup’s annual Values and Beliefs survey, conducted May 1-10. Since it was first fielded in 2001, this survey has found considerable evidence that Americans are becoming increasingly liberal in terms of what actions or behaviors they find morally acceptable.

From 2011 onward, notable shifts in opinion are apparent for actions such as doctor-assisted suicidegay/lesbian relations, sex between unmarried people and having a baby out of wedlock.

Scott Sauls–Thoughts on LGBTQ+, Porn, Promiscuity, Community, and Christian Faithfulness

These are just two examples that indicate how the tide has shifted in Western culture on the subject of sexuality. Whether it is Saturday Night Live teasing Jimmy Carter for confessing that he lusts sometimes; Woody Allen flippantly saying, “The heart wants what the heart wants” when pressed about his affair with his teenage stepdaughter; or sex-advice columnist Dan Savage advocating for open marriages because he thinks it’s unreasonable to expect people to be monogamous2, all indications are that, indeed, we are not in Leave It to Beaver land.

Historic Christianity, Judaism, Islam, and many other major world religions have always believed that God gave us sex for two reasons. First, sex is for procreation. The only way for new life to be formed is through the uniting of sperm and egg. Second, sex is a way for men and women, specifically husbands and wives, to give and receive pleasure through the uniting of two bodies into one. The one-flesh union renews and solidifies marriage vows. It serves as a reminder that husbands and wives are no longer independent but belong to each other, body and soul. The union of two naked bodies affirms every other form of nakedness—personal, emotional, and spiritual.

Yet negative reactions to the biblical vision for sex abound in modern Western society. The blogosphere and general public conversation reflect a variety of opinions on the subject of marriage and sexuality. Even within communities of faith, intramural debates and divisions abound over this single, heated issue. Is the “sex is only for marriage between one man and one woman” view too limiting? Worse, is it insensitive, unloving, and oppressive because of how it prohibits consenting adults who love one another—single, gay, straight, monogamous, and polygamous—from enjoying the same freedoms that husbands and wives do?

The church visitor’s Leave It to Beaver comment made me wonder if she was familiar at all with the biblical vision for sex. Neither the modern hookup nor the Leave It to Beaver culture reflects a biblical view of sexuality. Instead, the Bible puts forward a vision for sexuality that is both chaste and free.

Archbp Justin Welby–Christian Presence and Witness in Europe An address to the Assembly of the Conference of European Churches

Europe is not in danger of falling. And there is no sense in which I suggest that Brexit or other crises currently around will derail the European Union or bring about the downfall of
Europe. To suggest that would be akin to the old English saying that when there is fog in the Channel then the continent is cut off. But Europe, like other parts of the world, is in a
fragile phase. Current geo-political uncertainty is unsettling. In my part of the continent there is a nation attempting to leave the EU, on the other edges of the EU such as here there are countries and peoples keen to get in.

For Augustine the fall of Rome showed the specious nature of putting faith in the earthly city. For Augustine the benefit of being a Christian is citizenship of an eternal city. This
comes through faith in Christ.

That cannot lead to complacency. The fact that Christianity survived in Europe does not indicate that it is indestructible, but that God protects the Church that he created and loves.
Christian survival within Europe is not an objective of the Church, rather it should be for the Church to be obedient to the pattern of Christ, to be Christ’s hand, mouth and love in this
world today.

Jesus told his disciples that they were to be salt and light (Matthew 5: 13-16), both the means of preserving the society in which the Church exists and also the source of illumination that reveals both shadow and truth, that unveils what seeks to be hidden, and illuminates what inspires.

For the Church to be effective and to continue to be blessed by God, it must speak truth to the societies that it sees around it and act in a way that is consistent with the truth it
speaks….

Masterpiece Cakeshop Analysis (II): Douglas Laycock and Thomas Berg–Scotus Decision not as narrow as may first appear

The Supreme Court has announced a powerful ideal. Even when a law has no explicit exceptions, hostile enforcement is unconstitutional. Single-issue agencies that enforce state civil-rights laws must approach claims to religious exemptions with tolerance and respect. And this is apparently an absolute rule; the court does not consider whether hostility might be justified by some state interest, compelling or otherwise.

But a requirement of tolerance and respect, or even the avoidance of hostility, is difficult to enforce. The opponents of religious exemptions will now start doing the sorts of things done by many other government officials resisting constitutional mandates. They will seek doctrinal and rhetorical manipulations to cloak their hostility to the constitutional right, and their unequal treatment of objectors they agree with and objectors they don’t.

Those manipulations began in the state’s briefs and in the concurring and dissenting opinions. Kagan and Breyer said that the state’s discrimination could easily have been justified with a different explanation: The protected bakers would not have sold an anti-gay cake to anybody, but Phillips would sell wedding cakes to opposite-sex couples.

As Justice Neil Gorsuch explained, this reaches the preordained result by manipulating the level of generality. An “anti-gay” cake is distinguished only by what it displays on the outer surface. So the category is not cakes, or wedding cakes, but cakes with particular messages. If a same-sex couple wants a cake with two grooms, two brides, a rainbow, or any other indication of approval of same-sex marriage, that is a cake that Phillips would not sell to anybody. If they want a cake that could just as appropriately be used for an opposite-sex wedding, then at the surface, Kagan’s rationalization holds — but it is still a rationalization. Everyone would still know what is really going on: The commission agrees with the protected bakers and disagrees with Jack Phillips.

Masterpiece states an important ideal. But the Supreme Court has not been good over the years at identifying government bias or hostility that is the least bit shrouded. In a case without smoking-gun expressions of hostility, objectors will need evidence of inconsistent treatment of tester cases.

Masterpiece Cakeshop Analysis (I): Amy Howe–Opinion analysis: Court rules (narrowly) for baker in same-sex-wedding-cake case [Updated]

…the critical question of when and how Phillips’ right to exercise his religion can be limited had to be determined, Kennedy emphasized, in a proceeding that was not tainted by hostility to religion. Here, Kennedy observed, the “neutral and respectful consideration to which Phillips was entitled was compromised” by comments by members of the Colorado Civil Rights Commission. At one hearing, Kennedy stressed, commissioners repeatedly “endorsed the view that religious beliefs cannot legitimately be carried into the public sphere or commercial domain, implying that religious beliefs and persons are less than fully welcome in Colorado’s business community.” And at a later meeting, Kennedy pointed out, one commissioner “even went so far as to compare Phillips’ invocation of his sincerely held religious beliefs to defenses of slavery and the Holocaust.” “This sentiment,” Kennedy admonished, “is inappropriate for a Commission charged with the solemn responsibility of fair and neutral enforcement of Colorado’s anti-discrimination law—a law that protects discrimination on the basis of religion as well as sexual orientation.” Moreover, Kennedy added, the commission’s treatment of Phillips’ religious objections was at odds with its rulings in the cases of bakers who refused to create cakes “with images that conveyed disapproval of same-sex marriage.”

Here, Kennedy wrote, Phillips “was entitled to a neutral decisionmaker who would give full and fair consideration to his religious objection as he sought to assert it in all of the circumstances in which this case was presented, considered, and decided.” Because he did not have such a proceeding, the court concluded, the commission’s order – which, among other things, required Phillips to sell same-sex couples wedding cakes or anything else that he would sell to opposite-sex couples and mandated remedial training and compliance reports – “must be set aside.”

But the majority left open the possibility that a future case could come out differently, particularly if the decisionmaker in the case considered religious objections neutrally and fairly. Other cases, the majority emphasized, “must await further elaboration in the courts, all in the context of recognizing that these disputes must be resolved with tolerance, without undue disrespect to sincere religious beliefs, and without subjecting gay persons to indignities when they seek goods and services in an open market.”
